Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Rassberry mobile application, related services, and website (together, the “Services”), operated by the legal entity identified in our Privacy Policy or provided on request (“Rassberry”, “we”, “us”). By creating an account or using the Services, you agree to these Terms.
1. Eligibility
You must be at least 18 years old to use the Services. By using Rassberry, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2. Account
You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it updated. Notify us promptly at support@rassberry.eu if you suspect unauthorised access.
3. Licence to use the Services
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the Services for their intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Services except as permitted by law.
4. Your content
You retain rights to content you submit (“User Content”). You grant Rassberry a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute User Content solely to operate, promote, and improve the Services, enforce our rules, and comply with law. You confirm you have the rights to grant this licence.
5. Acceptable use
You agree not to:
- Harass, threaten, defame, or harm other users;
- Post illegal content, non-consensual intimate imagery, hate speech, or content that exploits minors;
- Impersonate others or misrepresent your identity or affiliation;
- Spam, scrape, or use automated means to access the Services without permission;
- Attempt to reverse engineer, probe, or disrupt the Services or other users’ devices;
- Use the Services for commercial solicitation outside permitted venue features;
- Violate applicable law or third-party rights.
We may investigate violations and cooperate with law enforcement. See also our Privacy Policy for how we process data for safety.
6. Moderation & enforcement
We may remove content, suspend, or terminate accounts at our discretion, including for breaches of these Terms, risk to community safety, or legal requirements. We are not obligated to monitor all content but may do so.
7. Subscriptions & payments
Optional paid features (e.g. Rassberry Plus) are billed through the Apple App Store or Google Play. Prices, renewal, and cancellation are governed by the applicable store’s terms. To the extent permitted by law, all charges are non-refundable except as required by the store or mandatory consumer law. If you believe a charge is incorrect, contact the store first, then us.
8. Third-party services
The Services rely on third parties (e.g. cloud infrastructure, maps, authentication). Their terms and privacy policies may also apply.
9. Intellectual property
Rassberry’s name, logo, and branding are our property. Do not use them without our prior written consent except as allowed by law.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
Rassberry is a platform. We do not conduct background checks on all users. You are solely responsible for your interactions with others. Always take reasonable precautions when meeting people offline.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RASSBERRY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY EUROS (€50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW (E.G. GROSS NEGLIGENCE OR INTENT).
12. Indemnity
You will defend and indemnify Rassberry against claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Services, or your breach of these Terms, to the extent permitted by law.
13. Termination
You may stop using the Services at any time. We may suspend or terminate access with or without notice. Provisions that by nature should survive (e.g. licences granted to us for necessary retention, liability limits, governing law) will survive termination.
14. Changes
We may modify these Terms. We will post the updated Terms on this page and update the effective date. If changes are material, we will provide additional notice where required by law (e.g. in-app). Continued use after the effective date constitutes acceptance.
15. Governing law & disputes
These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules. Courts in the Netherlands shall have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence that cannot be waived.
If your legal entity is established elsewhere, replace “the Netherlands” with the appropriate jurisdiction after legal advice.
